Terms of ordering

Jessenia, a.s. (hereinafter referred to as the "Operator") undertakes not to disclose the information that the User provides about himself when creating his user account to any third party, except as provided by law. In the event that such information is personal data, it will be handled in accordance with Act No. 101/2000 Coll., on the Protection of Personal Data, as amended (hereinafter referred to as the "Personal Data Protection Act").

The user hereby agrees, within the meaning of the Personal Data Protection Act, to the processing of personal data provided by the operator for the purpose of providing the services provided by the operator through the website operated by the operator and for the purpose of the performance of the operator's activities as a provider of health services. The personal data will be processed by electronic means and to the extent that corresponds to the purposes set out in the previous sentence.

The user agrees that the personal data provided by him/her will be kept in the database of the operator as a data controller.

The subject's access to information pursuant to Section 12 of the Personal Data Protection Act:

  1. If the data subject requests information about the processing of his/her personal data, the controller is obliged to provide him/her with this information without undue delay.
  2. The content of the information is always a communication about:
    1. the purpose of the processing of the personal data,
    2. the personal data or categories of personal data, as the case may be, which are the subject of the processing, including any available information on their source,
    3. the nature of the automated processing in relation to its use for decision-making, where such processing results in acts or decisions which affect the rights and legitimate interests of the data subject,
    4. the recipients or categories of recipients.
  3. The controller shall have the right to charge a reasonable fee for the provision of the information, not exceeding the costs necessary to provide the information.
  4. The obligation of the controller to provide information to the data subject, as provided for in Section 12 of the Personal Data Protection Act, may be fulfilled by a processor on behalf of the controller.

Protection of data subjects' rights § 21 of the Data Protection Act:

  1. Any data subject who becomes aware or believes that the controller or processor is carrying out processing of his or her personal data which is contrary to the protection of the private and personal life of the data subject or contrary to law, in particular if the personal data are inaccurate with regard to the purpose of the processing, may:
    1. request an explanation from the controller or processor,
    2. request that the controller or processor remedy the situation. In particular, this may include blocking, rectification, completion or destruction of the personal data.
  2. If the data subject's request under paragraph 1 is found to be justified, the controller or processor shall rectify the defective situation without delay.
  3. If the controller or processor does not comply with the data subject's request pursuant to paragraph 1, the data subject shall have the right to apply directly to the Data Protection Authority.
  4. The procedure referred to in paragraph 1 shall not preclude the data subject from submitting his or her complaint directly to the Data Protection Authority.
  5. Where the processing of personal data has caused damage to the data subject other than pecuniary damage, the procedure for pursuing his or her claim shall be governed by a specific law.
  6. If, in the processing of personal data, there has been a breach of the obligations imposed by the Data Protection Act on the controller or on the processor, they shall be jointly and severally liable.
  7. The controller shall inform the recipient without undue delay of the data subject's request pursuant to paragraph 1 and of the blocking, rectification or destruction of the personal data. This shall not apply if informing the recipient is impossible or would require disproportionate effort.

The user confirms that he/she has read the information of the operator about the right to request information from the operator about the processing of personal data and sensitive data pursuant to Section 12 of the Data Protection Act and the obligation of the operator pursuant to Section 21 of the Data Protection Act. The user has the right to request an update of the personal data processed.

The User hereby agrees, within the meaning of Act No. 480/2004 Coll., on Certain Information Society Services and on Amendments to Certain Acts, as amended, that the Operator may send him/her e-mails with information about the Operator's services or third party products.

This consent is granted for an indefinite period and the user is entitled to withdraw it at any time.
